The present document constitutes the General Terms and Conditions of Sale of the FINOVAUTOS.COM website. Its purpose is to define the terms of consultation and use of the Site and its Elements by the User and the purchase of a car by a Customer.

Article 1 - Scope of application

The Customer acknowledges that he/she is of legal age and has the capacity to contract. In order to proceed with the purchase of the Vehicle, the Customer must follow a series of steps described below:

Article 2 - Order validation

The Customer must confirm that he/she has read and understood these Terms and Conditions, as well as the General Warranty Conditions. The Customer shall send the documents required to validate the order, including in particular a copy of his/her ID and proof of address, as well as payment of the legal and transport costs, in order to validate the order by electronically signing the entire Contractual Documentation (hereinafter the "Order Form").

That's right, To validate the order of a car and to have delivery, the customer must accept and be able to pay by bank transfer a deposit of order according to the modalities chosen at the time of the order. 

To validate the purchase, you must pay the amount shown for the car plus the costs of legalization, registration and delivery (Standard or VIP) depending on your destination country, defined as follows:

  • For deliveries in Europe excluding DOM TOM (France, Belgium, Portugal, Spain, Romania, Italy...), we offer a choice of two delivery methods:
    1- Standard delivery which takes place under 7 to 10 days for a flat rate of €1,500 with all the documents needed to put the car on the road (vehicle registration document, plates and registration certificate, etc.), including legalization, taxes and other administrative formalities.
    2- La livraison VIP at the end of 3 to 5 days for a flat rate of €1,750 with all the documents needed to put the car on the road (vehicle registration document, plates and registration certificate, etc.), including legalization, taxes and other administrative formalities.
  • For French overseas departments and territories, we also offer a choice of two delivery methods:
    1- La livraison maritime standard on roll-on/roll-off vessels 5 to 7 weeks for a flat rate of 2500 €including all the documents required to put the car on the road, administrative formalities and various taxes (vehicle registration document, plates and registration certificate, dock dues, customs clearance, and other necessary costs).
    2- La livraison VIP (car delivered in a 20-foot container), which takes an average of 25 days for a flat rate of 3500 €including all the documents required to put the car on the road, administrative formalities and various taxes (vehicle registration document, plates and registration certificate, dock dues, customs clearance, and other necessary costs).

IMPORTANT: Delivery charges are independent of the ordering method chosen by the customer and must be paid before the car is loaded.

Article 3 - Down payment

The Customer acknowledges and agrees to be bound by these Terms and Conditions and the General Terms and Conditions. guarantees. The Customer will pay, according to the terms of order 30% or 50% of the price corresponding to a deposit. The deposit will be deducted from the Price upon full payment of the Vehicle. The balance will be paid on the day of delivery of the vehicle to the country of destination.

Article 4 - Registration and administrative procedures

New or used motorhomes, vans or converted vans belong to the VASP (Véhicules Automoteurs Spécialisés) category. As such, you are not required to pay the ecotax. As a result, our company will take care of all administrative formalities up to and including final registration, and will assign you a sales representative, agent or delivery agent to take care of delivery and administrative formalities.

Article 5 - Payment terms

The Customer may pay the deposit by bank transfer. The balance of the Vehicle Price will be paid by bank transfer. If the Customer chooses to pay the balance by bank cheque, he/she must send the cheque by registered post, together with its deposit slip, to the company's address.

Article 6 - Documentation

documents The vehicle will be delivered with maintenance booklet, maintenance invoices, COC, provisional registration, mileage certificate, CARTE GRISE OFFICIELLE (Plaque), CERTIFICAT DE NON GAGE, CONTRÔLE TECHNIQUE, CARNET D'ENTRETIEN (constructeur), MAINTENANCE INVOICE, CERTIFICAT DE CESSION, CERTIFICAT DE CONFORMITE.

Article 7 - ON-SITE PURCHASE

Customers can visit our warehouses in Germany to test-drive and buy on the spot. They can then decide whether to take the vehicle with them or opt for delivery. If the customer decides to leave with the vehicle directly, he/she will no longer be able to exercise a right of withdrawal.

Article 8 - Vehicle delivery

1 / Place of delivery

All vehicles sold by the Concession are available for delivery in France and throughout Europe. Delivery is made, in accordance with the Purchase Order, to the address indicated by the Customer (excluding addresses belonging to automotive professionals). In certain cases, the Customer may request delivery to one of the Company's partner establishments. The Company undertakes to deliver the Vehicle to the agreed location and the Customer to take delivery of the Vehicle on the agreed date and at the agreed location.

2 / Delivery date

The Vehicle will be delivered to the Customer within 10 days from the date of signature of the Purchase Order and payment of the deposit. However, if the Customer takes out financing for the purchase of the Vehicle, the delivery period will be 10 days from acceptance of the financing contract by our finance department.

When the Vehicle can be made available to the Customer, the Customer will receive a provisional delivery date by e-mail. The delivery date can also be viewed in the customer's personal environment. The Customer will then be contacted by the delivery company, a partner of the Company, in order to set a definitive delivery time. The delivery company will send the Customer an SMS confirming the Vehicle delivery time. The Customer has 12 hours from receipt of the SMS to request a change to the agreed time. Failing this, the Customer is deemed to have accepted the date and time indicated and undertakes to be present at the precise time of the agreed appointment.

Article 9 - Right of withdrawal

1 / Exercising the right of withdrawal

The Customer has fourteen (14) days from delivery of the Vehicle to exercise his right of withdrawal, without having to justify his decision or pay any penalties.

The Customer wishing to cancel the Order must send the Company the duly completed withdrawal form attached to the Order Form within the above-mentioned period. The Customer must be able to prove that he has exercised his right of withdrawal.

2 / Vehicle return

Customers exercising their right of withdrawal must return, at the same time as they take back the Vehicle, all documents and accessories given to them upon delivery of the Vehicle and listed on the delivery report. The Company will collect the withdrawn Vehicle from the place where it was delivered. The Company will then examine the Vehicle and draw up a repossession report. The examination of the Vehicle will be carried out on the basis of the documents relating to the condition of the Vehicle sent to the Customer at the time the order was placed, and on the basis of the delivery report. If, when drawing up the trade-in report, the Company finds that the Vehicle :

- has been damaged,
- is aware of defects that did not exist at the time of delivery,
- accessories and/or documents sent to the customer at the time of delivery are missing,
- the Vehicle has travelled more than 500 kilometers since delivery (including the distance covered by the convoy).

The Company may make reservations and obtain reimbursement from the Customer for repairs to be carried out on the Vehicle, as well as reimbursement of the amounts required to replace documents and/or accessories. Any sums owed by the Customer for damage to the Vehicle will be deducted directly from the refund.

If the number of kilometers travelled since delivery exceeds 500 kilometers, the Customer shall compensate the Company for each kilometer travelled in excess of this threshold at a rate of 1 euro per kilometer, inclusive of tax.

The sums due by the Customer for excess kilometers travelled will be directly deducted from the reimbursement.

The Customer acknowledges that he/she will not be reimbursed for any costs incurred in processing the order which do not correspond to the price of the Vehicle (administrative costs, cost of the registration certificate and excess delivery costs).

In the event of retraction and in accordance with Article L221-23 of the French Consumer Code, the Customer shall bear all costs relating to the return of the Vehicle.

Sums due by the Customer for the cost of returning the Vehicle will be deducted directly from the Reimbursement.

The cost of returning the Vehicle from the Customer's home will be 499 euros.

However, if the Customer returns the Vehicle to one of the Company's partner establishments (option available only for certain Vehicles) or to the Dealership, no return costs will be charged.

In the event of withdrawal, the Customer must return the Vehicle within 14 days of delivery.

The provisions of this article do not apply to legal entities or individuals acting in the course of their commercial, industrial, craft, liberal or agricultural activities.

3 / Refund

If the right of withdrawal is exercised under the conditions defined above, the sums paid by the Customer for the Purchase Order (hereinafter referred to as the "Reimbursement") will be reimbursed within 14 days of receipt of the withdrawal form. The sum paid by the Customer is automatically increased by 10 % if the Reimbursement is made no later than thirty days after this term, by 20 % up to sixty days and by 50 % thereafter. Reimbursement following cancellation of the Order will be made by bank transfer or cheque, which the Customer accepts.

Article 10 - Payment of VAT

Certain conditions imposed by ANTS for imported vehicles, including the all-important VAT tax receipt. Payment of VAT is compulsory, and will enable us to complete all the formalities for turnkey delivery and a vehicle registration document in your name. You should be aware that VAT is automatically refundable by the service in charge upon delivery of the imported vehicle and presentation of the delivery note. This will take place after all administrative formalities have been completed.

Article 11 - Payment of the balance due

Payment of the balance due will be made exclusively by bank transfer to the order of the agent in charge of the order, which must appear on the account no later than four (4) days before delivery in the case of home delivery.

For the purchase of a new car, payment of the balance due will be made exclusively by bank transfer to the order of the agent in charge of the order, which must appear on the account no later than the 25th day of the current accounting month*.

It is important to remind our customers that payment in full of the order price at the time of sale with payment in instalments of our new vehicles does not exceed one month, as we are obliged to pay the manufacturer as soon as the order is placed.

Article 12 - Transfer of risk and ownership

Ownership of the Vehicles sold will be transferred to the Customer upon issuance of the registration certificate in the Customer's name, and the risks relating to the Vehicles will be borne by the Customer upon issuance of the new registration certificate in the Customer's name.

The seller retains ownership of the vehicles until full payment of the price and related fees and taxes by the customer, with formalities relating to the issue of a new registration certificate only being carried out once the price has been paid in full.

Article 13 - Complaints

You have the right to lodge a complaint with a supervisory authority of the Commission Nationale de l'Informatique et des Libertés by sending a letter to the following address: CNIL - 3, place de Fontenoy - TSA 80715 - 75334 Paris - Cedex 07. The customer may also make any complaint by contacting the Company by post at the following address: Friedrichstraße 16, 42929 Wermelskirchen, Germany.

Article 14 - Legal warranty of conformity

In accordance with the provisions of Articles L217-4 et seq. of the French Consumer Code, the Customer benefits from the legal guarantee of conformity. The Company is obliged to deliver goods in conformity with the Contract and is liable for any defects in conformity existing at the time of delivery.

In the event of a lack of conformity, the Company chooses between repair and replacement.

Article 15 - Assignment

The Company may freely assign all or part of this Contract to any company controlled, controlling or under the same control within the meaning of articles L233-1 et seq. of the French Commercial Code.

Article 19 - Jurisdiction and applicable law
In the event of a dispute, the Company and the Customer undertake to attempt to resolve the dispute between them in good faith and amicably. If the attempt to resolve the dispute amicably is unsuccessful, the parties may bring the dispute before the competent courts. These Conditions are governed by French law.

Have your new car delivered safely to your home by a professional driver. When you reserve your vehicle, you can choose personalized delivery at home or at the location of your choice anywhere in Europe or French overseas departments and territories. 

Flexibility

You can choose day and time for delivery at your convenience. Your vehicle will be delivered at a time that suits you best. We'll call you back to confirm time slot of delivery.

Documentation

We deliver our cars on a turnkey basis, i.e. with all the regulatory papers below in the purchaser's name and in compliance with the country of destination:

  • CARTE GRISE OFFICIELLE (License plate) - CERTIFICATE OF NON-PLEDGE - TECHNICAL CONTROL - MAINTENANCE CARNET (manufacturer) and MAINTENANCE INVOICE - CERTIFICATE OF TRANSFER - MILEAGE CERTIFICATE - CERTIFICATE OF CONFORMITY
